Welcome to the MBAweb Site (the "Site"). These "Terms of use" govern your use of the Site and its contents. The terms "MBAweb," "we," "us" and "our" refer to MBAweb, a Trademark of MBA Recherche Inc.

By using the site, you agree to these "Terms of use", the MBAweb "Privacy statement", the MBAweb "Community guidelines" and the MBAweb "Contest rules" and you agree to receive required notices and to transact with us electronically. If you do not agree, please do not use the site.

1. Registration

You must register on this Site in order to use certain of the Site functions, such as our surveys, bulletin boards, etc. If you just want to browse this Site, registration is optional. During registration, you will be required to provide contact information, consisting of an email address and password.

2. Age of users

Children under the age of 13 may not use this service and parents or legal guardians may not agree to these "Terms of use" on their behalf. If we become aware that a child under 13 has provided or attempted to provide us with personal information, we will use our best efforts to remove the information permanently from our files.

If you are under the age of 16 but at least 13 years of age, you may use this Site only under the supervision of a parent or legal guardian who agrees to be bound by these "Terms of use". If you are a parent or legal guardian agreeing to these "Terms of use" for the benefit of a child between the ages of 13 and 16, be advised that you are fully responsible for his or her use of this Site, including all financial charges and legal liability that he or she may incur.

3. Non-commercial use

This Site and its contents are for your own personal non-commercial use only.

4. Additional terms and conditions for Software; EULAs

When you [download and/or install and use MBAweb’s downloadable software] [register for or purchase the Site’s services], you will be required to agree to one or more "End-User License Agreements" (or "EULAs") which may include additional terms. You will be bound by any "End-User License Agreements" (or "EULAs") that you agree to.

5. MBAweb privacy statement

Your use of this Site signifies your continuing consent to the MBAweb "Privacy statement", which you can examine any time by clicking on the "Privacy" link on the Site. Personal information that you supply to MBAweb, and any information about your use of MBAweb that we obtain will be subject to the MBAweb "Privacy statement" on this Site.

6. Changes to MBAweb

We may discontinue or change any MBAweb content, service, function or feature at any time with or without notice.

7. Proper use of this site

When you use our blogs or other social and communications functions, you agree at all times to comply with the MBAweb "Community guidelines", which you may access with the "Community guidelines" link on the Site. You may use MBAweb for lawful purposes only and may use the Site only in ways consistent with the law. You may not use any program, spider or "bot" to gather or "harvest" information from this Site.

8. Proprietary rights

MBAweb and its suppliers reserve all rights under intellectual property law in MBAweb and in any content that is on the Site. Except as MBAweb may expressly state in writing, you may not reproduce, reprint, publish, or otherwise exploit content or technology from MBAweb or its suppliers on the Site without our express prior written consent.

9. Changes to the terms of use

We may change the "Terms of use" at any time. You can review the most current version of the "Terms of use" by clicking on the Site's "Terms of use" link. If you continue to use this Site after we make changes to the "Terms of use", you are signifying your acceptance of the new terms. You are responsible for checking these terms periodically for any changes.

10. Electronic delivery statement and your consent

You agree that we may provide to you notices and other information concerning MBAweb or this Site electronically, including notice to any email address that you may provide.

11. Content that you supply

MBAweb may allow you to supply content for the Site or its functions that can be accessed and viewed by others. You agree not to post any content that violates these terms, any applicable "End-User License Agreements" (or "EULAs") or the "Community guidelines". Content that violates applicable rules may be removed. If you post any content on any blog or other public area of the Site, you grant us and our affiliate companies the perpetual sublicensable right and license to use, copy, display, perform, distribute, modify, adapt, abridge, exploit, and promote this content in any way and in any commercial or non-commercial medium or form without charge.

12. No duty to monitor

You agree that we are not liable for content that is provided by others. We have no duty to screen content that you may supply or post, but we have the right to refuse to post or to edit submitted content. We reserve the right to remove any content for any reason at any time.

13. Third party sites and advertisers

MBAweb may include on its Site links to third party web sites. You agree that we are not responsible or liable for any content or other materials on third party sites. You also agree that we are not responsible for content or claims supplied by our advertisers. We are also not responsible for any transactions or dealings between you and any third party or any advertiser. You agree that MBAweb is not responsible for any claim or loss due to a third party site or any advertiser.

14. Disclaimer of warranties

We provide this Site and its contents "AS IS." We and our suppliers make no express warranties or guarantees about this Site. TO THE EXTENT PERMITTED BY LAW, WE AND OUR SUPPLIERS DISCLAIM IMPLIED WARRANTIES INCLUDING ANY WARRANTY THAT THE SITE IS OR WILL BE MERCHANTABLE, OF SATISFACTORY QUALITY, ACCURATE, TIMELY, FIT FOR A PARTICULAR PURPOSE OR NEED, OR NON-INFRINGING. WE DO NOT GUARANTEE THAT THIS SITE OR ITS CONTENT WILL MEET YOUR REQUIREMENTS, IS ERROR-FREE, RELIABLE, OR WILL OPERATE WITHOUT INTERRUPTION. Because some provinces do not permit disclaimer of implied warranties, you may have additional consumer rights under your local laws.

15. Limitation of liability

You may not assert claims for money damages arising from this Site or its contents. We and our suppliers shall not be liable for any indirect, special, incidental, consequential or exemplary damages, even if we knew or should have known of the possibility of such damages. Because some provinces or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such provinces or jurisdictions, our liability, and the liability of our company and suppliers, shall be limited to the extent permitted by law.

16. Indemnification

You agree to defend, indemnify, and hold harmless us and our parent and other affiliated companies, and our respective employees, contractors, officers, directors, and agents from all liabilities, claims, and expenses, including attorney's fees, that arise from your use or misuse of this Site. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.

17. International use

We make no representation that content on this Site is appropriate or available for use in locations outside Canada. If you choose to access this Site from a location outside Canada, you do so on your own initiative and you are responsible for compliance with local laws.

18. Choice of law and location for resolving disputes

You agree that the laws of the province of Quebec, Canada and Canadian federal law govern these terms of use, its subject matter, your use of the Site, and any claim or dispute that you may have against us, without regard to its conflict of laws rules, and that the "United Nations Convention on Contracts for the International Sale of Goods" shall have no applicability. You further agree that any disputes or claims that you may have against us will be resolved by a court located in the province of Quebec, Canada in the city of Montreal, and you agree and submit to the exercise of personal jurisdiction of such courts for the purpose of litigating any such claim or action. BY AGREEING TO THESE TERMS OF USE, YOU ARE: (1) WAIVING CLAIMS THAT YOU MIGHT OTHERWISE HAVE AGAINST US BASED ON THE LAWS OF OTHER JURISDICTIONS, INCLUDING YOUR OWN; (2) IRREVOCABLY CONSENTING TO THE EXCLUSIVE JURISDICTION OF, AND VENUE IN, THE PROVINCIAL OR FEDERAL COURTS IN THE PROVINCE OF QUEBEC OVER ANY DISPUTES OR CLAIMS YOU HAVE WITH US; AND (3) SUBMITTING YOURSELF TO THE PERSONAL JURISDICTION OF SUCH COURTS FOR THE PURPOSE OF RESOLVING ANY SUCH DISPUTES OR CLAIMS.

19. Severability and integration

This contract and any supplemental terms, policies, rules and guidelines posted on this Site constitute the entire agreement between you and us and supersede all previous written or oral agreements. If any part of the "Terms of use" is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect.

20. Termination

We reserve the right to terminate your use of this Site if you violate the "Terms of use" or any rules or guidelines posted on the Site or for any other reason in our discretion.

21. Claims of copyright infringement

If you believe that your work has been copied and is accessible on this Site in a way that constitutes copyright infringement, please contact us to report possible copyright infringement at panel@mbaweb.ca.

22. Privacy policy

Do you have any questions or concerns? Do you wish to make a formal complaint about our privacy practices? You may do so in writing to our "Privacy Officer". They will acknowledge receipt of your complaint; ensure that it is investigated promptly and that you are provided with a response in writing.

Privacy statement

This "Privacy statement" details the policies and practices of MBA Recherche («we») regarding the treatment of personal information and informs you about the personal information that we gather about you via our website or by our online or telephone questionnaires. It explains how we use and divulge this information, the choices open to you with respect to these uses, and the manner in which you may correct the information we have in our possession.

We take the protection of your personal information to heart. We may sometimes update the "Privacy statement". This statement is effective since the date of "last revision" which figures at the top of this page. We will treat your personal information in accordance with the privacy policy in force at the moment at which that information is gathered and within our privacy policy except where we obtain your consent that such information be treated differently. This privacy applies to all information that we gather or receive about you, wherever it comes from. This site is reserved for Canadian residents.

1. What is meant by personal information?

Personal information is defined as data which allow the identification of a specific person. This information can include your name, your age, your gender, your address, your telephone numbers, your email address as well as your opinions and point of views.

2. How do we gather your personal information?

We always gather your personal information by legal and fair means, including your email address, when you give us permission or by other means permitted by law. Also, in order to ensure data integrity when you subscribe to the panel and when you answer our surveys, we use a computer validation technique of the Internet Protocol Address (IP) that was assigned to you by your Internet service provider. We also use a computer validation technique (PHP) allowing us to obtain additional non-personally identifiable data (operating system, date and time, cookies, etc.). This data does not enable us to identify you personally.

3. Partnerships

We can receive your email address via a third party or via a process of co-subscription. If you indicate that you wish to take part in our panel via the intermediary of one of our co-subscription partners, your email address may be communicated to us in order that we may send you a link to our sign up page. Our co-subscription partners can also simply direct you to a sign up page on our website, in which case your email address will not be given to us until you provide it during the subscription process.

The contractual agreements made between us and our co-subscription partners guarantee that your personal information will not be shared with anyone else or used for any other purpose.

4. How do we use your personal information?

We use your personal information to conduct market research studies via surveys and focus groups and this, only in ways permitted by law. In all cases, the identity of respondents is protected at all times.

5. How do we use your email address?

We use your email address to confirm your subscription to our panel, in order to allow the proper management of your profile and also to send you invitations to participate in focus groups and online surveys. It is necessary to receive these emails in order to participate in our research projects.

6. How can you unsubscribe?

All our emails and our surveys include a link to unsubscribe. By clicking on the unsubscribe link, you will go to a web page where you will be able to easily unsubscribe by following the on-screen process. You can also request to stop receiving emails by contacting us at panel@mbaweb.ca. We will treat your request within a period of 10 working days after having received it.

7. Divulgation of personal information

We reserve the right to divulge your personally identifying information when the law requires it and when we determine that the divulgation of such information is necessary in order for us to conform to a judgment, a ruling or a judicial act.

8. How and when do we obtain your consent?

We obtain your consent before collecting and before using or divulging your personal information, including your email address, for whatever purpose. Your consent may be obtained orally or in written form, for example, when you answer a survey.

9. What measures have we put into place to protect your personal information?

We have put into place security measures which are physical, organizational and technological, and which aim to protect your personal information, including your email address, against loss, theft and access, divulgation, copy, use or non-authorized modification. The only employees who may access your personal information, including your email address, are those who «need to know» or whose tasks reasonably require such access.

The systems used to save your personal information, including your email address, are housed in a secure data centre. We prevent electronic intrusion by using firewall technology. Employees who have been granted access to your personal information, including your email address, may access it only by using secure connections and passwords within our network.

10. Notice of modification on information already recorded in our database

If we decide to modify our confidentiality policy, we will display the modifications within this declaration of confidentiality and in the appropriate areas so that our users may always be informed about the type of information we gather and the use that we make of it. The personal information will be used in accordance with the privacy policy in effect at the time the information was collected.

In any case, if we intend to use members’ personally identifying information, including their email address, in a way that differs from those indicated at the time the information was gathered, we will inform the users by email. They may then accept or refuse the usage of their personal information in the described manner. However, users who have cut off all communication with the website or who have deleted/deactivated their account will not be contacted and their personal information will not be used in the new manner described.

In addition, if we make significant changes to our confidentiality practices which do not affect the information already entered in our database, we will display a visible notice to that end on our website. In certain cases, in addition to displaying a notice, we will send an email to users who have chosen to receive communications from us in order to inform them of the changes made to our confidentiality practices.

Contest Rules

Last revision: July 15th 2026

1. Official rules

Notwithstanding any applicable laws, the present rules regulate all aspects of the contest and bind all its participants.

2. Duration of the contest

The quarterly contest begins on July 15th 2026 at 12:00 am, Eastern Standard Time and ends on October 14th 2026 at 11:59 pm, Eastern Standard Time. The contest has a first prize of $1000.00, 2 prizes of $500.00, 4 prizes of $250.00 and 10 prizes of $100.00. Each of your participations in a pre-recruitment questionnaire for focus groups or in an MBA Recherche online survey gives you an additional chance to win one of the prizes.

3. How to take part

To participate in the "MBAweb panel" contest, you must complete a pre-recruitment questionnaire for paid focus groups or an MBA Recherche online survey within the deadlines that are specific to the contest. Each time you complete a pre-recruitment questionnaire or an MBA Recherche online survey, you increase your chances of winning a prize. Chances are cumulative within the contest duration boundaries and are reset for the following quarterly draws.

4. Eligibility

The contest is open to all participants who will fully complete a pre-recruitment questionnaire or an online survey amongst the questionnaires submitted during the contest time period. Your chances of winning depend on the number of participants during the contest as well as the number of questionnaires completed.

To be eligible for the different prizes, participants must be Canadian residents of age according to the legislation in their place of residence. MBA Recherche's employees, including its advertising and promotional agencies, as well as those of any other party directly or indirectly involved in the contest, including their family members and household members, may not participate in this contest. No purchase necessary. Each participant accumulates chances according to the number of pre-recruitment questionnaires or surveys completed during the contest time period. When a participant is declared the winner, their chances to win are reset for the next draw.

5. Prize's description

17 prizes will be attributed to 17 participants who will have completed one of the pre-recruitment questionnaires for paid focus groups or MBA Recherche online survey during the indicated contest time period. Each of your participations to a pre-recruitment questionnaire for paid focus groups or MBA Recherche online survey gives you an additional chance to win one of the prizes.

  • Prize No. 1: $1000.00 in Canadian dollars;
  • Prize No. 2 and 3: $500.00 in Canadian dollars;
  • Prize No. 4, 5, 6 and 7: $250.00 in Canadian dollars;
  • Prize No. 8, 9, 10, 11, 12, 13, 14, 15, 16 and 17: $100.00 in Canadian dollars.

6. Prize awarding

The contest draw will take place at MBA Recherche and MBAweb’s offices at 7261 23e avenue, Montréal, Québec, Canada, H2A 2E7, on October 15th 2026, at 12:00. In order to be declared winners, participants will receive an E-mail indicating the prize that will be awarded. The winner must forward the requested information within 10 days following the sending of this E-mail. In case of non-response, the prize may be attributed to another participant. The participant must correctly answer, by phone, the following regulatory question: (45+15) X 5 - 100. The participant will not be declared an official winner if the relevant checks have not been done.

7. General Information

MBA Recherche is exempt from any liability in the event of lost, stolen, delayed, damaged, incomplete or improperly forwarded registrations, of viruses on the web site or computer bugs during the contest, network outages or technical problems, or technical problems with the phone line, the computer systems, the servers, the internet access service providers, or problems with installations or computer material or software, or any email error or transmission delay, or any other electronic transmissions transmitted by or to MBA Recherche or to its agents as a result of any technical problems or internet congestion or on any other web site, or any of the above-mentioned factors in combination, including any injury or damage caused to any participant or to any other person linked with computers or as a result of participating in the contest, including using the contest website or the transmission and reception of emails.

i. Without restricting the scope of the "Contest rules", MBA Recherche reserves the right, at its entire discretion, (subject to approbation, if applicable, by the Régie des alcools, des courses et des jeux du Québec) to modify, suspend or terminate the contest, in whole or in part, (and, at its discretion, to name one or more winners among the registered participants) if for any reason whatsoever, in the opinion of MBA Recherche and at its discretion, the contest did not proceed normally, notably because of falsification, unauthorized human intervention, fraud, violation of contest rule, errors or technical malfunctions, or a virus, a computer bug or any other cause that could alter the security and the administration of the contest.

ii. Any attempt to deliberately damage any website, to obtain unauthorized access to another person's computer or to adversely affect the good functioning of the contest is a legal infraction. In the event where a person would make such an attempt, MBA Recherche reserves the right, not only to disqualify this person from the contest, but also to fully exercise its right to remedy in damages under the law including, if deemed necessary, criminal proceedings.

iii. Personal information obtained on participants registered to this contest is used solely for the purposes of the contest and to participate in other potential focus groups and online surveys with or without remuneration. Under no other circumstances will the personal information obtained be sent to third parties. Please consult MBA Recherche's Information protection policy at www.mbaweb.ca.

iv. In order to receive his prize, the participant must provide a photo of himself so that it may be published on our site’s list of winners and on our main page or anywhere else on the www.mbarecherche.com and www.mbaweb.ca websites, as well as on MBA Recherche and MBAweb’s social media. The photo should show the winner displaying the name MBAweb.ca to confirm the validity of our winners to our panelists and respect our display norms.

8. Advertising

By accepting the prize, the winner authorizes MBA Recherche, the organizers of the contest, to use his/her name, address, photograph, voice or image, or any declaration regarding the contest, for advertising purposes, and this, without any form of compensation. All entries become the exclusive property of MBA Recherche and will not be returned.

9. Litigation (for residents of Canada only)

Any litigation concerning the organization or how the current contest is held can be submitted to the Régie des alcools, des courses et des jeux du Québec. Similarly, any litigation concerning how prizes are awarded under the current contest can also be submitted to the Régie des alcools des courses et des jeux, for sole purposes of regulation.

Community guidelines

The MBAweb online community consists of all those people that use the online resources of the MBAweb web site (the "Site") to exchange information, content and ideas. The community will thrive based on mutual respect and consideration. Your use of the Site and its resources is subject to these "Community guidelines". We can change these "Community guidelines" at any time by posting the changed version on the Site. Here are rules that apply to the Site and its resources for the purpose of making our community better:

1. No objectionable content

You should not supply or post any content or message that is abusive, belligerent, slanderous, racist, vulgar or sexually explicit or otherwise offensive. Never use the Site or its resources to insult or attack other persons. Don’t write in all capital letters; it is considered shouting and it is also harder to read. You should not promote or encourage illegal content.

2. No commercial activities

You may not use the Site or its functions to promote your own or any other business or commercial activity. Do not make offers to buy or sell using the Site or its resources. You may not attempt to drive traffic to any other site for commercial gain. You may not promote or run any contest, chain letter, investment opportunity, or any other form of solicitation or pyramid scheme by means of the Site or its resources.

3. Truthful dealings

Any information that you supply should be true to the best of your knowledge. You should not use any false identity and should not claim false credentials.

4. Respecting privacy of others

You should not disclose the name, address or other personal information about third parties without their express permission. You should not encourage or request others to disclose personally identifying information.

5. Age restriction

Children under the age of 13 are not permitted to register on this Site or use any functionality for which registration is required. You should not permit or encourage any violation of this rule.

6. Titles for posting

Please give your posts a meaningful title so that members and visitors do not spend time reading posts about things they have no interest in. Make your title descriptive, reflecting the topic you are addressing, rather than a generic title such as "Question" or "I Need Help."

7. Legal compliance; No illegal filesharing

You may use the Site and its resources only in full accordance with applicable law. In particular, you should never post or exchange content, data, or files that infringe any third party copyright, trademark or other proprietary rights. Unauthorized sharing of copyrighted content is not permitted.

8. No hacking or spamming

You may not circumvent any Site protections and safeguards, and you may not redirect messages and communication to other sites. You should never use the Site’s functionality for unauthorized mail or messages or any form of "spamming."

9. Password security

Keep your password private. You should not share your account with others.

10. Violations and reports

Feel free to report violations or abuse. Contact MBAweb at the following email address: panel@mbaweb.ca. MBAweb does not monitor content that is exchanged or posted by means of MBAweb. However, we reserve the right to remove any content that we determine, in our sole discretion, to be inappropriate. We also may remove any content or activity in violation of these rules or the Site "Terms of use". We may terminate any user account or any user’s access to the Site and its functionality if we believe that there has been any violation.
